Nevertheless, for Users to benefit from certain services or access to their personal accounts, ART DE VIVRE informs that they exercise the collection of personal data being defined as any information, which allows them to directly or indirectly identify the visitors of the Website.

More precisely, the collection is made during browsing on the Website, during the registration of subscription to the online magazine, through the creation of a personal account or during making purchases on the Website of ART DE VIVRE. 

 The present policy aims at the information of Users of ART DE VIVRE practices regarding the collection, use and the sharing of information of Users. ART DE VIVRE is liable for this data processing. ARTICLE 2. INFORMATION COLLECTED

The Website of ART DE VIVRE collects the following categories of information: 

1. To establish the identity: surname, name, email address, telephone, IP addresses to identify possible malicious Users and fraudsters;

2. To determine the interests: purchased lectures, courses, magazines or other goods and services offered by ART DE VIVRE;

3. Statistical utilisation data: time stamping of the first and the last connection, pages views, Cookies, connection time on the Website of ART DE VIVRE and geolocation for statistical and market research purposes.

We primarily use your information for the purpose of delivering the products and services that you have chosen and to personalise our interactions (including advertising) with you. For further details about this, and other ways we may use your information, please read the sections below.

All the information is collected with the consent of Users, and allows ART DE VIVRE to send them our ads or those of our partners. 

ARTICLE 3. INFORMATION WE DO NOT COLLECT 

We do not track or collect any sensitive information about you. This includes race, religion, ethnicity, political opinion, etc.

ARTICLE 4. COLLECTION MODALITIES 

ART DE VIVRE collects the data based on the following principles:

  1. Fair and lawful obtainment and processing of the collected information;
  2. Registration for the purposes determined below and in conformity with those (Article 5);
  3. Appropriate use of the information, relevant and not excessive regarding the finalities;
  4. Precautions taken to ensure the data’s security and confidentiality in order to avoid that they could be damaged, modified or given to unauthorized third parties.

ARTICLE 5. COLLECTION PURPOSES

  1. ART DE VIVRE collects information for the following purposes: 
  2. Creation and management of a User account; 
  3. On-line order fulfilment until their delivery or request for the subscription or for quotation of any magazine material; 
  4. Commercial prospection via offers personalized or not, for Users or whether for magazine’s subscribers;
  5. Statistical studies and analysis of the purchasing habits of Users of ART DE VIVRE;
  6. Data spot check, hosting or computer maintenance. 

ARTICLE 6. HOLDING AND TRANSFER OF INFORMATION

The data collected by ART DE VIVRE are intended for its own use and for the use by the subcontractors (if any). Subcontractors are defined as contractual providers who need to process purchases and order of Users on the Website and the processing of some services proposed by ART DE VIVRE.

The subcontractors and service providers are subject to an obligation of confidentiality and can use the data only in compliance with the contractual provisions and the legislation in force.

ART DE VIVRE uses all the necessary means in order to take the appropriate measures to ensure the protection, the confidentiality and the security of the personal data given by Users, in accordance with the legal applicable provision.

ARTICLE 7. TIME LENGTH OF DATA RETENTION

Personal data will be kept during a three years period within the last exchange between the User and ART DE VIVRE.

Personal data deletion will be made at least one time per civil year, except:

  1. In case of previous exercise of the data deletion right in the conditions described below (Article 8);
  2. In case a longer length of retention is authorized, or imposed, under a legal or regulatory provision. 

ARTICLE 8. SECURITY

Personal data are processed in order to ensure a maximum security of any information received.

For this purpose, ART DE VIVRE establishes organizational measures to avoid any internal data leakage or theft, technical measures and software updates and appropriate IT infrastructures to protect data against any cyber-attack and against computer viruses.

ART DE VIVRE checks but does not guarantee that its subcontractors and service providers execute all the appropriate security measures for the personal data they process.

ART DE VIVRE also commits to analyse and regularly evaluate the efficiency of these measures.

ARTICLE 9. RIGHTS AND EXERCISE’S MODALITIES

Right of access to the data: which allows access to a copy of data collected by ART DE VIVRE.

Right to object: at any moment, any User can oppose the data processing for marketing aims or to the processing made.

Right to erase data and right of rectification: every User has the right to request deletion of their personal data at any time. It should be noted that if the law imposes it or in case of legitimate reason, ART DE VIVRE can keep some information while generally suspending processing the User’s data.

Portability right: every User has the right to transmit their data processed by ART DE VIVRE in a structured, commonly used and readable format to another processing controller.

Right to limitation: every User has the right to ask for the suspension of the data processing, subject to applicable regulation.

Right to be forgotten: every User has the right to be completely forgotten.

 The exercise of the rights is made on a request, accompanied by a valid credential with the holder’s signature, sent to ART DE VIVRE by email to the address: contact@artdevivre.com. 

Any request has to be clear and precise in terms of the rights that the User wants to exercise.

Besides the first contact with the responsible of data protection at ART DE VIVRE, any User has the possibility to contact the National Commission for Data Protection and Liberties (more information on www.cnil.fr) or has the right to lodge a complaint.

ARTICLE 10. THE RIGHTS OF THE USERS UNDER GDPR 

You have a right to ask us for information we hold about you, “Subject Access Request”, so that we can respond as promptly as possible please send us an email to contact@artdevivre.com. 

ARTICLE 11. THE RIGHTS OF THE USERS UNDER CCPA 

You have a right to ask us what information we have “sold” about you, where “sold” includes sharing your personal data with selected third parties, when you have given us permission to do so by opting in to marketing. For this purpose, send us an email to contact@artdevivre.com. 

ARTICLE 12. WHO ARE THIRD PARTIES?

Our services sometimes use additional information such as telephone numbers or postcodes from third parties (like researchers, agents or analytical services, who have gathered this information lawfully) to help us to contact you with important service updates via phone or post or to help us make marketing decisions. This includes advertising (by ourselves or via advertising partners) to groups of people with particular interests. These third parties may receive your personal information, if you have allowed us to transfer it.

We may also work with third parties to identify individuals who may be interested in ART DE VIVRE or in some cases our sponsors / advertisers’ products and services. ARTICLE 14. HOW CAN THE USERS OPT OUT OF MARKETING? 

You can update your preferences at any time, and for subscribers of ART DE VIVRE, this can be done via your online account at artdevivre.com, or by contacting customer services by mail contact@artdevivre.com. You can also opt out of email marketing by clicking the unsubscribe link at the bottom of our emails.

ARTICLE 15. HOW CAN THE USERS UPDATE THEIR INFORMATION?

You can update it at any time via your online account at artdevivre.com (for subscribers), or contact us. 

ARTICLE 16. DELETION OF INFORMATION 

Any user can ask us to delete the information by contacting us. We will consider your request and take appropriate action which may mean that we suppress it, rather than delete it to ensure that we can still follow your preferences as to whether or not we can market to you.
